1. Who we are

tratti.ai is operated by Alexander Ellul, a self-employed sole trader established in Malta (Fairwinds PH A14, Tumas Galea Street, Luqa, Malta, VAT No. MT19763931) ("tratti", "we", "us"). Contact: [email protected], +356 79260967.

2. These terms

These Terms of Service govern your use of tratti.ai as a visitor or buyer. Photographers and event organisers are additionally bound by the separate Photographer Agreement and Event Organiser Agreement accepted at onboarding. By using the site or making a purchase you agree to these terms. We may update them from time to time; material changes will be announced on the site and do not apply retroactively to completed purchases.

3. What the service is

tratti.ai is a marketplace where independent photographers sell photos and videos taken at events. Preview images are watermarked; purchased files are delivered without watermarks. Some events are private and require a password provided by the event organiser.

AI disclosure: the photo-finding feature ("Find my photos") is an artificial-intelligence system. When you upload a selfie, automated face-matching software compares it against photos from the event you select and shows you likely matches with a confidence score. Matches are suggestions, not guaranteed to be accurate or complete. Section 5 and our Privacy Policy explain how your data is handled.

4. Accounts

You can browse and search without an account; an account is needed to purchase and download. You may register with an email address or a supported social login. Keep your credentials confidential — you are responsible for activity under your account. You must provide accurate information and be at least 16 years old to create an account (younger users need a parent or guardian to purchase on their behalf).

5. Face search and saved selfies

Consent. Face search processes biometric data and only runs with your explicit consent, which we ask for when you upload a selfie. You may only upload a selfie of yourself. Uploading a photo of another person to search for their photos is prohibited, except that a parent or legal guardian may search for photos of their own child under 18.

One-time search. Your selfie is compared against the selected event's photos and deleted as soon as the search completes — it is not kept after your search unless you choose to save your selfie. No face template is retained.

Saved selfie and match alerts. You can optionally save your selfie to your account so that we can email you when newly uploaded photos match your face. This requires a separate opt-in. You can delete your saved selfie at any time in account settings, which deletes the selfie and stops match alerts immediately.

Age. Face search is available to users aged 16 or over, and to parents/guardians searching for their own children as described above.

6. Prices and payment

All prices are shown in euro and include VAT. Volume pricing may apply — the per-photo price can decrease as you add more photos from the same event, as shown in your cart. Promotional codes apply as described at checkout and cannot be exchanged for cash. Payment is processed by Stripe; we do not store your card details.

7. Tokens

You may pre-purchase token packs and spend tokens on face-search checks and photo purchases instead of paying by card at each step. Tokens: (a) can only be used on tratti.ai; (b) are not transferable and cannot be exchanged for cash; (c) do not expire; and (d) unused tokens are refundable at the price paid within 14 days of buying the pack (if none of the pack has been spent). Statutory rights are unaffected.

8. Digital delivery and your right of withdrawal

Purchased files are available immediately in "My Purchases" (individually or as a ZIP), and we email you when your order is ready. Under EU consumer law you normally have a 14-day right of withdrawal from distance purchases. Because photo and video downloads are digital content delivered instantly, at checkout we ask you to expressly consent to immediate delivery and to acknowledge that you thereby lose the 14-day right of withdrawal. Without that consent we cannot deliver instantly.

9. Faulty content and refunds

If a purchased file is defective — corrupted, wrong resolution, wrong image delivered, or still watermarked — contact us at [email protected] and we will redeliver a conforming file or refund you, as EU digital-content rules require. Because you can inspect watermarked previews before buying, we do not refund purchases simply because you no longer want an image you previewed, but genuine mistakes (e.g. an obvious mis-match from face search) are treated sympathetically — get in touch.

10. Your licence to purchased content

Photographers retain copyright in their work. When you purchase, you receive a non-exclusive, perpetual, worldwide licence to download and use the purchased files for personal, non-commercial purposes — including printing, sharing with family and friends, and posting on your personal social media. You may not resell, redistribute, sublicense, or use purchased files commercially (including in advertising or merchandise) without the photographer's separate written permission. You may not remove watermarks from preview images or use previews in place of purchased files.

11. Acceptable use

You must not: upload a selfie of someone else (except your own child, as above); attempt to identify strangers; scrape, bulk-download or republish site content; circumvent watermarks, passwords or payment; use the service for any unlawful purpose; or interfere with the operation or security of the platform. We may suspend or close accounts that breach these terms.

12. People appearing in photos — removal requests

If you appear in a photo on tratti.ai and want it removed, or want your face excluded from face-search indexing, email [email protected] with a link to the photo(s). Removal is free and processed within 30 days at the latest. See the Privacy Policy for details of your rights.

13. Availability and liability

We provide the platform with reasonable skill and care, but do not guarantee uninterrupted availability or that face-search results are complete or accurate. Nothing in these terms excludes liability that cannot legally be excluded (including for fraud, death or personal injury caused by negligence, or your statutory consumer rights). Subject to that, we are not liable for losses that were not foreseeable when you made a purchase, and our total liability to you in connection with a purchase is limited to the amount you paid for it.

14. Governing law and complaints

These terms are governed by the laws of Malta. If you are a consumer residing in another EU member state, you also benefit from the mandatory consumer protections of your country of residence, and you may bring proceedings in your local courts. Complaints: contact us first at [email protected] — we aim to respond within 14 days. Maltese consumers may also contact the Malta Competition and Consumer Affairs Authority (MCCAA); EU consumers may use their national European Consumer Centre.
